6. Conflicts of Interest
The Firm performs conflict checks before accepting representation. If a conflict arises during representation, the Firm may withdraw in accordance with professional rules.
7. Termination of Services
Either party may terminate the attorney-client relationship at any time, subject to applicable ethical obligations. Upon termination, the Firm will provide a final invoice and return any client property.
8. No Guarantee of Outcome
The Firm does not guarantee any specific outcome. Legal and financial results depend on numerous factors beyond the Firm’s control.
9. Use of Technology
The Firm may use email, cloud-based platforms, and other technologies to communicate and store information. While reasonable security measures are taken, the Client acknowledges inherent risks.
10. Governing Law
These Terms shall be governed by the laws of the State of Georgia, without regard to conflict of law principles.
11. Dispute Resolution
Any disputes arising from these Terms or the Firm’s services shall be resolved through binding arbitration in Forsyth County, Georgia, unless otherwise agreed.
12. Amendments
The Firm may update these Terms from time to time. Clients will be notified of material changes.
13. Performance Obligations and Fraudulent Conduct
All Traders, Contractors, or third-party service providers retained by or affiliated with Mark Henry, Kendall Jenner., Quick Capitlal and Credit, Attorney and Lawyers LLC, and Q Capital and Holdings LLC to perform tasks related to proprietary trading firm challenges (“Prop Firm Challenges”) are expected to act in good faith and with commercially reasonable efforts to fulfill their obligations.
A. Breach of Contract by Traders
Any trader who:
Accepts payment or compensation for the purpose of completing a Prop Firm Challenge,
Fails to use best efforts to pass the challenge,
Engages in deceptive, negligent, or fraudulent conduct,
shall be deemed in material breach of contract.
B. Legal Remedies
In the event of such breach, Q Capital and Holdings LLC reserves the right to pursue civil litigation against the offending party for damages up to $1,000,000 USD or more, including but not limited to:
Recovery of paid fees,
Lost opportunity costs,
Reputational harm,
Punitive damages were applicable.
C. Enforcement
The Firm may initiate legal proceedings in any jurisdiction where the trader resides or conducts business. The Client agrees to cooperate fully in any investigation or enforcement action.
